Cj Concierge Service Agreement
This Agreement covers the Client's use of CJ Concierge, the AI phone receptionist, at one location. The Order Form (Schedule A) carries everything that changes per location.
1. Parties and definitions
1.1 Parties. This Service Agreement (the "Agreement") is between The RGM Group Holding Inc., operating as Canadian Jeweller Magazine, 920 Yonge Street, Suite 608, Toronto, Ontario M4W 3C7 ("CJ", "we", "us"), and the business named on the Order Form (the "Client", "you").
1.2 Definitions. In this Agreement:
(a) "AI Output" means anything the Receptionist says, writes or generates, including answers, bookings, messages, transcripts and summaries.
(b) "Applicable Law" means all laws that apply to a party's activities under this Agreement, including privacy, call recording, anti-spam, telemarketing, consumer protection, language and AI disclosure laws in the places where the Client and its Callers are located.
(c) "Business Day" means Monday to Friday, excluding statutory holidays in Ontario.
(d) "Caller Notice" means the notice described in section 7.5.
(e) "Callers" means the people who phone the Client's store, including the Client's customers.
(f) "Client Data" means information about Callers and the Client's customers that the Service collects or stores, including names, phone numbers, emails, call recordings, transcripts, summaries and appointments.
(g) "Go-Live Date" means the day the Client approves the Receptionist in writing and switches on call forwarding to it.
(h) "Order Form" means Schedule A, submitted online or signed, listing the location, plan, options and fees.
(i) "Qualifying Outcome" means an appointment the Receptionist books into the Client's calendar, or a message or lead record the Receptionist creates that includes a Caller's name and a phone number or email, in each case from a call placed by someone other than the Client, its staff or CJ, and not a test call.
(j) "Receptionist" means the AI voice assistant that answers calls for the Client's store.
(k) "Service" means CJ Concierge, the Receptionist and the booking, messaging and reporting tools that come with it, as described in section 2.
(l) "Store Account" means the Client's own customer management account (calendars, contacts, notes, repairs pipeline) that CJ sets up and operates for the Service.
(m) "Store Information" means the facts the Client gives CJ for the Receptionist to use, such as hours, services, brands, approved prices and policies.
2. The Service
2.1 Description. CJ provides an AI receptionist that answers the Client's forwarded calls and handles routine requests using the Client's Store Information.
2.2 Included in the monthly fee
(a) Answering calls forwarded to the Receptionist during the times set by the answering mode on the Order Form, subject to section 8, in the languages chosen on the Order Form (any of English, French, Spanish, Mandarin, Hindi, Vietnamese, Tagalog, Korean and Arabic). Accuracy can be lower in languages other than English and French, and the Receptionist will offer a message or transfer when it cannot help confidently.
(b) Booking appointments into the Client's calendars (for example bridal consultations, appraisals, gold buying and repair drop-offs) and sending a confirmation to the Caller by email or text under section 7.13.
(c) Giving repair and watch service status from the Client's repairs pipeline, only to a Caller who gives both the job number and the surname on the job. The Receptionist gives the status and ready date only, never the item's description, value or the customer's other details.
(d) Taking messages and flagging ready-to-buy Callers to the Client by email, and by text when enabled.
(e) Transferring calls to the store during opening hours when a Caller asks for a person.
(f) A summary and recording of each call saved to the Store Account, and a monthly call report.
(g) Setup, hosting, maintenance and reasonable changes to Store Information, up to 4 change requests a month.
(h) One standard voice from CJ's voice list.
2.3 Not included. The Service does not include: taking payments or card details by phone; appraisals, valuations or authenticity opinions; outbound calls of any kind; legal, tax or financial advice to Callers; emergency calls (the Receptionist is not an emergency service, and Callers in an emergency must call 911); any information about the store's security, staffing schedules, deliveries, cash, safes or stock on hand; and integration with point-of-sale or other systems beyond those listed on the Order Form, unless agreed in writing.
3. Setup and go-live
3.1 Steps
(a) Kick-off. A 30-minute call in which the Client gives CJ its Store Information and completes the kick-off checklist.
(b) Build and test. CJ configures the Receptionist and Store Account and runs its own test calls.
(c) Client testing. The Client calls the Receptionist and tells CJ what to change. CJ makes reasonable changes the same Business Day where possible.
(d) Approval and go-live. The Client approves the Receptionist and the Caller Notice in writing (email is enough) and switches on call forwarding at its phone carrier.
3.2 Timing. CJ aims to have the Receptionist ready for approval within 2 Business Days after the kick-off call ends and the kick-off checklist is complete. This is a target, not a guarantee, and it pauses while CJ is waiting on the Client.
3.3 Start of monthly fee. The monthly fee starts on the Go-Live Date and never starts before the Client switches on call forwarding to the Receptionist.
3.4 Stalled setups. If the Client has not approved the Receptionist within 30 days after the kick-off call for reasons not caused by CJ, CJ may end this Agreement by written notice and keep the setup fee.
4. Fees and billing
4.1 Currency and taxes. Fees are in US dollars and do not include taxes. The Client will pay any GST/HST, QST, provincial sales tax, or US state or local sales, use or communications tax that CJ is required by law to collect, shown separately on the invoice. Where CJ is not required to collect a tax, the Client is responsible for any tax it must self-assess. Each party pays its own income taxes.
4.2 Fees. The fees per location are:
| Item | Amount (USD) | When charged |
|---|---|---|
| Setup fee | $399, one time | At signup. Non-refundable once the kick-off call has taken place, except (a) under the 30-day setup guarantee in section 4.6, or (b) if CJ cancels before the Go-Live Date for a reason not caused by the Client. |
| Monthly plan | $499 a month | On the Go-Live Date (or as set by section 4.7), then monthly in advance |
| Included call minutes | 1,000 a month | Unused minutes do not carry over |
| Extra minutes | $0.20 a minute | Monthly in arrears, counted from the call records |
| Premium or cloned voice (optional) | $100 a month | With the monthly plan |
4.3 Counting minutes. Minutes are counted per call, from when the Receptionist answers to when the call ends, rounded up to the next minute. Calls made during setup and Client testing before the Go-Live Date are not counted. CJ will email the Client when a location reaches 80% of its included minutes in a month.
4.4 Price changes. CJ may change prices with 60 days' written notice. The change applies from the next billing period after the notice ends. The Client may cancel before then without penalty.
4.5 Payment. The Client authorizes CJ to charge the card on file automatically for fees when due. If a payment fails, CJ will email the Client and retry. If a payment is still unpaid 14 days after its due date, CJ may suspend the Service under section 5.5. The Client is responsible for its own phone carrier charges for call forwarding.
4.6 30-day setup guarantee
(a) If no Qualifying Outcome occurs during the 30 days starting on the Go-Live Date (the "Guarantee Period"), CJ will refund the setup fee in full.
(b) The guarantee applies only if, for the whole Guarantee Period, the Client kept call forwarding to the Receptionist switched on for the answering mode chosen on its Order Form, kept at least 10 hours a week of bookable times open in its calendar, and did not switch off booking or message taking. Interruptions caused by CJ or its providers do not count against the Client.
(c) The Client must request the refund by email to concierge@canadianjeweller.com within 15 days after the Guarantee Period ends, and will make that request before disputing any charge with its card issuer.
(d) CJ's call records decide whether a Qualifying Outcome occurred, and CJ will share the relevant records with the Client on request. CJ will refund to the original card within 10 Business Days after a valid request.
(e) The guarantee covers the setup fee only. Monthly fees, extra minutes and add-ons are not refunded. It applies once per location and not to a location that has used CJ Concierge before. The guarantee also applies to Founding Stores.
(f) A refund does not end this Agreement. The Client may cancel under section 5.2.
4.7 Founding-store offer
(a) The first 10 Clients whose Order Forms CJ accepts and marks "Founding Store" receive the first month of the monthly plan free. The first monthly charge is made one month after the Go-Live Date. Extra minutes and add-ons are billed as usual.
(b) After 30 days CJ will ask the Client for an honest written review of the Service. The free month does not depend on the review being positive, on any rating, or on the review being published, and it is not taken back if the Client declines to write one. The Client may say whatever it genuinely thinks, including criticism.
(c) CJ may publish the review, in full or in excerpts that do not change its meaning, only after the Client approves the final text in writing. Wherever CJ publishes it, CJ will state clearly beside it that the Client received a free month of service.
(d) CJ will not ask the Client to post a review on Google or any other third-party platform as part of this offer.
5. Term, cancellation and suspension
5.1 Term. This Agreement starts when the Client accepts it and continues month to month until ended under this section. There is no long-term commitment.
5.2 Cancellation by the Client. The Client may cancel by email to concierge@canadianjeweller.com. Cancellation takes effect 30 days after CJ receives the notice. A monthly charge that falls due within those 30 days is charged in full and not prorated, and no charge is made after the end date except for extra minutes already used.
5.3 Cancellation by CJ. CJ may cancel with 30 days' written notice for any reason and will refund any fees prepaid for the period after the end date.
5.4 Termination for cause. Either party may end this Agreement immediately by written notice if the other materially breaches it and does not fix the breach within 10 days after written notice. CJ may also end this Agreement by written notice if the Client removes or changes the Caller Notice without CJ's agreement, or if a carrier, regulator or subprocessor requires CJ to stop providing the Service to the Client.
5.5 Suspension. CJ may pause the Service if fees are unpaid more than 14 days after their due date, after giving at least 2 Business Days' notice by email, or immediately if the Service is being used unlawfully or puts Callers, CJ's systems or other clients at risk. CJ will tell the Client why and restore the Service once the cause is fixed.
5.6 After the end date. On suspension or termination the Client must switch off its call forwarding. For 7 days after the end date, CJ will play a short message telling Callers to call the store directly and giving its number, unless the Client asks otherwise. CJ is not responsible for calls missed after that.
6. Client responsibilities
6.1 Store Information and operations. The Receptionist is only as accurate as the Store Information it is given. The Client will:
(a) give accurate, complete Store Information and tell CJ of changes (hours, holidays, prices, policies, staff transfer number) at least 2 Business Days ahead;
(b) approve every price or price range the Receptionist may quote; the Receptionist will not quote anything else;
(c) keep its calendars and repairs pipeline up to date, so availability and repair status are correct;
(d) follow up on messages, hot leads and callbacks the Service passes on, in a reasonable time;
(e) honour bookings the Receptionist makes within the availability the Client set, or contact the customer to reschedule;
(f) set up and maintain call forwarding with its phone carrier, with a fallback to the store line or voicemail if the Receptionist does not answer;
(g) keep its account logins confidential and tell CJ of any unauthorized access;
(h) review call summaries and bookings regularly and tell CJ promptly of any error; and
(i) not instruct the Receptionist to say anything false or misleading to Callers.
6.2 Acceptable use. The Client will use the Service lawfully and will not use it to: impersonate another business or person; mislead Callers about who they are speaking with; collect payment card, banking or government identification numbers; make outbound calls or send marketing messages without a separate written order; record anyone without the Caller Notice; or collect information about a Caller's health or about children in a way that requires special consent.
7. Privacy, call recording and data
7.1 Roles. The Client is the organization responsible for Client Data under Applicable Law. CJ processes Client Data only on the Client's instructions in this Agreement and only to provide, secure and support the Service. CJ acts as the Client's service provider under the Personal Information Protection and Electronic Documents Act (Canada), Quebec's Act respecting the protection of personal information in the private sector, and the Personal Information Protection Acts of Alberta and British Columbia, and as a service provider or processor under US state privacy laws.
7.2 Ownership and use. Client Data belongs to the Client. CJ will not sell it, use it to market to Callers, or add it to Canadian Jeweller's own mailing or contact lists. Each Client's data is kept in its own separate Store Account, never mixed with other clients' data or CJ's own data. CJ may use anonymized, aggregated statistics (for example call volumes or booking rates across all clients) to run and improve the Service; these never include call content and never identify a Caller or the Client.
7.3 No model training. CJ does not use Client Data, recordings or transcripts to train or improve general AI models. Where a subprocessor offers a setting that excludes customer data from model training, CJ turns it on, and Schedule B shows each provider's status. CJ staff may listen to or read a Client's calls only to support, fix or improve that Client's Receptionist.
7.4 US privacy terms. Where the California Consumer Privacy Act or a similar US state law applies, CJ will not sell or share Client Data, will not retain, use or disclose it outside the direct business relationship with the Client, will not combine it with other data except as that law allows, will comply with that law, and will tell the Client if it can no longer meet these obligations. The Client may take reasonable steps to stop and remedy any unauthorized use.
7.5 Caller Notice. At the start of every call, before asking for any information, the Receptionist gives a notice approved by the Client in the greeting language, substantially as follows: "Thanks for calling [Store]. You've reached our AI assistant. This call is recorded and transcribed by our service providers to help with your request and improve our service. If you would rather not be recorded, just say so and we will have someone call you back." If the Caller declines, the Receptionist takes only a name and number, and CJ deletes that call's recording and transcript within 24 hours. Before transferring a call to the store, the Receptionist tells the Caller whether the rest of the call will be recorded. For stores in Quebec, the Receptionist greets Callers in French first. The Receptionist never claims to be a person.
7.6 Compliance responsibilities
(a) The Client is responsible for: (i) approving the Caller Notice and any change to it; (ii) its own privacy policy, which must describe the Service, the use of AI, call recording, and processing outside Canada and outside the Client's province or state (CJ will provide suggested wording); (iii) any consent needed for marketing; and (iv) telling CJ in writing if Applicable Law in its location requires a different notice or consent.
(b) CJ is responsible for: (i) delivering the approved Caller Notice on every call; (ii) processing Client Data only as this Agreement allows; and (iii) binding each subprocessor to data protection terms at least as protective as this section 7.
(c) Each party is responsible for claims caused by its own failure under this section, as set out in section 9.
7.7 Cloned voices. A cloned voice is created only from a person who has given CJ signed written consent, which the Client obtains and provides. The Client confirms it has the right to use that person's voice and likeness and will tell CJ at once if consent is withdrawn, in which case CJ will stop using and delete the cloned voice.
7.8 Retention. Recordings and full transcripts are kept in the Store Account for 90 days, then deleted. Contacts, appointments, notes and call summaries are kept for as long as this Agreement runs, unless the Client deletes them sooner. Copies held by subprocessors for operation or abuse monitoring are deleted on each provider's schedule, which CJ sets to the shortest period offered and lists in Schedule B. CJ keeps call logs without content (date, time, length, outcome) for 24 months for billing and guarantee checks.
7.9 Subprocessors. CJ uses the providers listed in Schedule B, which may process Client Data outside Canada, including in the United States, where it may be accessible to courts, law enforcement and national security authorities of that country. CJ will give 30 days' notice before adding a new subprocessor that handles Client Data. If the Client reasonably objects on data protection grounds, it may end this Agreement before the change takes effect and receive a refund of any prepaid fees for the period after the end date.
7.10 Security and breaches. CJ uses reasonable technical and organizational safeguards, including access controls, encrypted connections and separate credentials per store. CJ will notify the Client without undue delay, and in any event within 72 hours after confirming a breach of security safeguards involving Client Data. The notice will describe what happened, the data and Callers affected, and the steps taken, and CJ will update it as facts emerge and help the Client meet its own reporting duties. CJ will keep a record of every such breach for at least 24 months and will not notify Callers or regulators about the Client's data without the Client's approval unless the law requires it.
7.11 Requests from Callers. If a Caller asks to access, correct or delete their information, CJ will pass the request to the Client within 5 Business Days and help the Client respond.
7.12 Requests from authorities. If CJ receives a court order, subpoena or government request for Client Data, CJ will tell the Client before responding unless the law forbids it, disclose only what is legally required, and reasonably help the Client seek protection.
7.13 Messages to Callers
(a) The Service sends confirmations, reminders and repair-ready notices only to Callers who gave a phone number or email for that purpose during the call, and only about that booking or job.
(b) Every text and email names the store, gives its contact details and includes a working opt-out (for texts, "Reply STOP to opt out"). Opt-outs made by any reasonable means are honoured promptly and in any event within 10 Business Days.
(c) Reminder texts are sent only between 8 AM and 9 PM in the Caller's local time.
(d) Texts to US numbers are sent only after the Client's business is registered for A2P 10DLC through CJ's messaging provider. The Client will give accurate information for that registration and pay carrier registration fees at cost.
(e) The Service does not send marketing messages unless the Client orders them separately in writing and confirms it holds consent that meets Canada's Anti-Spam Legislation (CASL), the CAN-SPAM Act, the Telephone Consumer Protection Act and state telemarketing laws.
7.14 Security summary. Once a year, on request, CJ will give the Client a short written summary of its security measures and its subprocessors' security certifications.
8. AI limitations, availability and support
8.1 AI Output. The Receptionist is an AI system. AI Output can be wrong, incomplete or misheard. The Client must not rely on AI Output as the only record of a commitment to a customer. EXCEPT AS STATED IN THIS AGREEMENT, THE SERVICE IS PROVIDED WITHOUT ANY OTHER WARRANTY OR CONDITION, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT THE LAW ALLOWS.
8.2 Safeguards. The Receptionist uses only the Store Information and approved prices, takes a message rather than guessing, and does not take payments or give valuations. Every call is recorded and summarized so the Client can check what was said.
8.3 Availability. CJ targets 99.5% monthly availability of the Receptionist, excluding planned maintenance (announced at least 24 hours ahead, outside store hours where possible) and outages at the Client's phone carrier.
8.4 Monitoring and fallback. CJ monitors the Service and is alerted automatically when calls fail. If the Receptionist cannot answer, CJ's system will try to route the call to the fallback number on the Order Form.
8.5 Support. Support is by email to concierge@canadianjeweller.com, Monday to Friday, 9 AM to 5 PM Eastern. CJ responds to a Service-down report within 4 business hours and to other requests within 1 Business Day.
8.6 Service credits. If availability falls below 99.5% in a month, the Client receives a credit of 10% of that month's plan fee for each full 0.5% below the target, up to 50% of the monthly fee, applied to the next invoice when the Client asks within 30 days. If availability is below 97% in two consecutive months, the Client may also end this Agreement by written notice within 30 days and receive a refund of prepaid fees for the period after the end date. These credits and this right to end are the Client's sole remedies for unavailability.
8.7 No outcome guarantee. Apart from the 30-day setup guarantee in section 4.6, CJ does not guarantee any number of calls answered, bookings, sales or revenue.
8.8 Changes required by law. CJ may change the Caller Notice, message wording or a feature of the Service when needed to comply with a change in law, carrier rules or a subprocessor's terms, and will tell the Client in advance where possible.
8.9 Accessibility. The Receptionist will offer a transfer or callback to Callers who cannot use the voice assistant, including Callers using relay services.
9. Liability, indemnity, confidentiality and intellectual property
9.1 Liability cap. EACH PARTY'S TOTAL LIABILITY UNDER THIS AGREEMENT IS CAPPED AT THE GREATER OF (A) THE FEES PAID OR PAYABLE BY THE CLIENT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) US$2,500.
9.2 Indirect losses. NEITHER PARTY IS LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSSES, INCLUDING LOST SALES, LOST PROFITS, LOST BOOKINGS OR REPUTATIONAL HARM, EVEN IF WARNED THEY COULD HAPPEN.
9.3 Exceptions. The cap and exclusions in sections 9.1 and 9.2 do not apply to a party's fraud, gross negligence or wilful misconduct, a party's deliberate disclosure of the other's confidential information, or the Client's duty to pay fees. For claims arising from a breach of section 7 (privacy and security), including under CJ's indemnity in section 9.6(b), CJ's total liability is capped at three times the amount in section 9.1 instead of that amount.
9.4 AI errors. Because AI Output can be imperfect (section 8.1), CJ is not liable for a booking, message or answer the Receptionist got wrong, beyond correcting it promptly once told and the service credits in section 8.6, unless the error was caused by CJ's gross negligence or wilful misconduct.
9.5 Client indemnity. The Client will cover CJ's reasonable costs from third-party claims caused by inaccurate Store Information, prices the Client approved, the Client's own use of Client Data (including marketing without consent), changes the Client made or approved to the Caller Notice, the Client's failure under section 7.6, voice or likeness rights under section 7.7, or the Client's breach of Applicable Law.
9.6 CJ indemnity. CJ will cover the Client's reasonable costs from third-party claims (a) that the Service itself infringes a third party's intellectual property, (b) caused by a security breach resulting from CJ's failure to follow section 7, or (c) caused by CJ's failure to deliver the approved Caller Notice.
9.7 Indemnity procedure. The party seeking cover will notify the other promptly, let it control the defence with counsel of its choice, and cooperate at the other party's cost. Neither party may settle a claim admitting fault for the other without its written consent. Indemnities are subject to the caps in sections 9.1 and 9.3.
9.8 Confidentiality. Each party will keep the other's non-public business information confidential and use it only for this Agreement, during the term and for 3 years after. Client Data is protected under section 7 for as long as CJ holds it.
9.9 Intellectual property. CJ keeps all rights in the Service, its scripts, prompts, configurations, templates, software and know-how, and in improvements that do not contain Client Data. As between the parties, the Client keeps all rights in its name, logo, Store Information, Client Data and the transcripts and summaries of its own calls, and allows CJ to use them only to provide the Service. If the Client gives CJ suggestions, CJ may use them freely.
9.10 Reference. CJ may name the Client as a CJ Concierge client, or publish its review under section 4.7, only with the Client's written approval.
10. End of service and general terms
10.1 Data return. Within 30 days after the end date, the Client may ask, at no charge, for an export of its contacts, appointments, notes and call summaries in CSV format, and of recordings still within the retention period. CJ then deletes Client Data from the Store Account and its systems within 60 days after the end date, except where the law requires CJ to keep it.
10.2 Survival. Sections 4 (amounts owed and pending guarantee requests), 7 (for as long as CJ holds Client Data), 9 and 10 continue after the end of this Agreement.
10.3 Force majeure. Neither party is responsible for delays caused by events outside its reasonable control. This does not excuse the Client's duty to pay fees, and it does not reduce the service credits in section 8.6.
10.4 Assignment. The Client may not transfer this Agreement without CJ's consent, which CJ will not unreasonably refuse on a sale of the Client's store. CJ may transfer it to an affiliate or a buyer of the Service with notice to the Client.
10.5 Notices. Notices are given by email to the addresses on the Order Form. A notice by email is received on the next Business Day after it is sent. Notices of breach or termination to CJ must also go to concierge@canadianjeweller.com.
10.6 Changes. CJ may update these terms by email to the Client's billing email at least 30 days before the change takes effect, with a summary of what changed and a link to the new version. Changes are never retroactive, do not change fees (section 4.4 governs price changes) and do not change dispute resolution for a dispute already started. If the Client objects, it may cancel without penalty before the change takes effect and receive a refund of prepaid fees for the period after the end date. Otherwise, continued use after that date is acceptance.
10.7 Entire agreement. This Agreement, the Order Form (submitted online or signed) and Schedules B and C are the whole agreement and replace earlier discussions. If they conflict, the Order Form wins, then this Agreement, then the Schedules.
10.8 Governing law and disputes. This Agreement is governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be resolved by confidential binding arbitration seated in Toronto, Ontario, under the Arbitration Rules of the ADR Institute of Canada, before one arbitrator, by video unless the arbitrator orders otherwise, in English or French. Claims under US$25,000 are decided on written submissions, and CJ pays filing fees above US$500. Either party may bring a claim in small claims court where it qualifies, or seek an urgent injunction in any competent court. Claims are brought individually, not as a class or representative action.
10.9 Language. The parties have asked that this Agreement be drawn up in English. For Clients in Quebec, CJ provided the French version of this Agreement first, and the Client has expressly chosen to be bound by the English version. / Les parties ont demandé que la présente convention soit rédigée en anglais. Pour les clients du Québec, la version française de la présente convention a été remise en premier, et le client a expressément choisi d'être lié par la version anglaise.
10.10 Formation. The Client accepts this Agreement by ticking the acceptance box and completing checkout on CJ's signup page, or by signing it. Online acceptance has the same effect as a signature. The person accepting confirms they are authorized to bind the Client. CJ will email the Client a PDF copy of the accepted version, showing its version number and date. This Agreement may be signed electronically and in counterparts.
10.11 Relationship and general. The parties are independent contractors. If a term is unenforceable, the rest of this Agreement remains in force. A failure to enforce a term is not a waiver of it. Nothing in this Agreement prevents CJ from providing the Service to other jewellers, including competitors of the Client. Headings are for convenience only, and "including" means "including without limitation".

C.2 Privacy. Section 7.4 applies to the Client where the California Consumer Privacy Act or a similar state law applies to it.
C.3 Texting. Section 7.13(d) applies: no texts are sent to US numbers until A2P 10DLC registration is approved.
